Why not let the selling part be available at HC and leave the buying out?

But not capable of buying from SC to HC, obviously.

but you CAN recover items in HC for d2, so that's a moot point

But that softened the blow, hardcore in Diablo 3 will be more hardcore then in Diablo 2 because of this. It also prevents people from trying to kill each other just to get their loot in hardcore and promotes co-op. It's not as much a moot point as it is different from Diablo 2.

you can't kill ppl in hardcore for their loot. I have a good feeling hardcore in diablo 3 will also have the option of body recovery anyway
